1. Acceptance of Terms
By downloading, accessing, or using JEL UP ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must stop using the App immediately.
We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must provide a valid Indian mobile phone number for OTP verification.
- You must have a device capable of providing GPS location services.
- Your account is personal and non-transferable. You are responsible for all activity under your account.
3. Account & Authentication
- Accounts are created via one-time password (OTP) sent to your phone number. No traditional password is required.
- You must keep your device and authentication tokens secure. Do not share your login session with others.
- We reserve the right to suspend or deactivate accounts that violate these Terms.
4. How JEL UP Works
JEL UP is a hyperlocal social networking platform. The core experience involves:
- Radar: See other users within 100 meters of your current location.
- Pings: Send anonymous connection requests to nearby users.
- Chats: If the other user accepts your ping, a persistent chat is created between you.
- Visibility: You control whether you appear on the radar.
The App requires location access to function. Without it, core features will be unavailable.
5. Acceptable Use
You agree not to:
- Use the App for any illegal, harmful, or fraudulent purpose.
- Harass, threaten, stalk, or intimidate other users.
- Send spam, promotional content, or unsolicited messages.
- Impersonate another person or misrepresent your identity.
- Upload obscene, violent, or hateful content as your profile picture or in chat messages.
- Attempt to reverse-engineer, scrape, or exploit the App or its APIs.
- Circumvent rate limits, blocks, or security measures.
- Create multiple accounts for abusive purposes.
6. Pings & Rate Limits
- Pings are rate-limited to 5 pings per 10 minutes to prevent spam.
- A ping expires if not accepted or declined within a reasonable time.
- Once a ping is accepted, both users gain access to a persistent chat.
- You can block a user at any time to stop all future interactions.
7. Chat & Messaging
- Chats are created only when a ping is mutually accepted. You cannot message someone without their consent.
- Messages are stored on our servers and delivered in real time via WebSocket connections.
- We do not actively monitor chat content, but we may review messages if a user reports abuse.
- Chats are persistent — there is no automatic expiration. You can block a user to deactivate a chat.
8. Blocking & Safety
- You can block any user at any time. Blocking immediately hides you from the other user and deactivates any shared chats.
- Blocked users cannot send you pings, see you on the radar, or contact you.
- If you feel unsafe, block the user and contact us at the email below.
9. Account Deletion
- You may delete your account at any time from within the App.
- Deletion is a soft delete: your account is deactivated, your profile is hidden, and your chats are disabled. Your data is retained for up to 30 days for recovery, after which it may be permanently removed.
- To request immediate permanent deletion, contact us via email.
10. Intellectual Property
- The JEL UP name, logo, design, and code are owned by us and protected by applicable intellectual property laws.
- You retain ownership of the content you create (messages, profile info), but grant us a limited license to store and transmit it as part of the service.
- You must not use our trademarks without prior written permission.
11. Disclaimers
- JEL UP is provided "as-is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free operation.
- We are not responsible for the behavior of other users. Meetings facilitated through JEL UP are at your own risk — exercise caution when interacting with people you don't know.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from or related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim (which, for a free service, is zero).
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
